Fatwa has no legal sanction [Indian Supreme Court]

The All India Personal Law Board had earlier submitted that a fatwa was not binding on people and it was just an opinion of a ‘mufti’ (cleric) and he has no power or authority to implement it.

The petitioner had submitted that the fundamental rights of Muslims could not be controlled and curtailed through fatwas issued by ‘qazis’ and ‘muftis’ appointed by Muslim organisations

Taking a very important decision, the Supreme Court on Monday, July 7, ruled out that Fatwas and Sharia courts are illegal. The apex court claimed that the Sharia courts, which dispense justice among Muslim community members, have no legal sanctity and at times their order infringes the fundamental rights of the people.

No, I don't want you to issue fatwa because in much of islamic world the woman cannot issue a fatwa :D

But yes I would like to get your feedback on this supreme judgement :)

BTW, what's your take on banning women from driving, being member of a parliament, and most other duties? Such is the law in some so called islamic states.

shhhhh.....she won't go live in those countries brother, because she wanted freedom and that's the reason why she chose to make USA as her home by default.

Like in malaysia/ saudi etc etc most woman are told to stay at home [no business, no work etc etc]....Zznoor runs a company with 30 some employees, that wouldn't have been possible for her if she was living in these retarded countries.

There's a secret weapon in Saudi Arabia often forgotten and frequently ignored by the West: Saudi women — and they are smart, intelligent and qualified. Thanks to the Muslim injunction to seek knowledge from the cradle to the grave, they are educated to the same level as, if not higher than, the men, and their grades are often better. They are PhDs, have second degrees and exercise huge influence in the family, or extended family; they organize the households, marriages and other rites of passage and they understand the social and tribal webs and networks.

Because of the basis of inheritance in shari'ah (Islamic law), they own considerable fortunes in their own right and indeed a good part of the wealth of the country. They also don't have to change their names following marriage. Under shari'ah a woman is supposed to have control of her inheritance, dowry before and after marriage. Many businesses are owned by women, according to the lists kept by the regional Chambers of Commerce & Industry. But these lists have not made a distinction between those businesses actively run by women and those owned by them. For instance, in the industrial sector industries owned by women amount to more than SR4.5 billion ($1.2 billion), but few women are actively running these investments.

Yet they can't have a driver's license, be a member of a parliament and most other duties, and they have to wear burqa [I am sure against their will, if not all at least some of them]... the article that you posted is very subjective and biased and may not reflect the reality in its totality. You would know if you lived there. Anyways, I am not here to say if they are right or wrong. It was simply my observation and understanding and more so the reality.

When you treat women like vegetable and then try to justify yourself by saying they are well educated, that does not change the reality of islamic States, some of which have miserably failed to give a respectable place to women in society.

It may be cultural but in the case of India and Pakistan you can see the gap when the only difference is religion. Why are Muslim using Islam to transform their society into a disabling environment for half of their population?

Spot on noor !!!

If you would have noticed, Ismailis does not follow the interpretation on Hanbal or any other imams as we speak. Ismailis do not follow what the majority of the ummah follows.

In short, Ismailis do not follow what arabs want them to follow because all the so called practices or shariah is man made or arab invented [after the demise of our holy prophet[pbuh]]

Luckily, ismailis have a living imam who guides them according to the time.
